1. Mirage-ISP is a division of Mirage Technology Group (hereinafter called MTG). This document represents the Acceptable Use Policy (AUP) of MTG and all its divisions. This AUP documents the rules, regulations and restrictions that binds all users of Mirage Technology Group's internet services. All Clients of every network run by, operated by and or hosted by MTG and its subsidiaries are subject to compliance with this policy, without exception. From time to time Mirage Technology Group may modify its AUP without any notice. When modified, the AUP becomes effective upon either the publication of such modified AUP to our website located at http://www.mirage-isp.com/legal/aup.htm, or the forums located at http://forums.mirage-isp.com . It is the customer's duty to ensure that he reads and is familiar with our current policies at every point in time. It is the duty of every reseller of our services or our dedicated server customers to inform their end users of this AUP and ensure its adherence. 2. Illegal Use. The MTG network may only be used for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is libelous, defamatory, constitutes an illegal threat, violates export control laws or regulations or encourages conduct that would constitute a criminal offense or give rise to civil liability. "Warez Sites", "Irc Bots", "Mp3" or hosting irc channels on our network are strictly prohibited. 3. System and Network Security. Violations of system or network security are prohibited. Examples of system or network security violations include, without limitation: a. Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network; 4. Abuse. The following acts are considered to be abusive of the MTG network and are prohibited: a. Any conduct which violates the accepted norms and expectations of the Internet community at large including, without limitation, posting or distributing information or materials which are abusive or threatening. MTG reserves the right to determine, in its sole discretion, whether any particular conduct violates such norms and expectations; 5.SPAM. MTG prohibits Subscribers from engaging in the following e-mail related activities: a. Sending unsolicited bulk e-mail ("UBE", or "SPAM"). This includes but is not limited to the distribution of UBE for commercial, informational, advertising, political, or religious purposes; transmit unsolicited bulk or commercial messages or "spam." This includes, but is not limited to, unsolicited advertising, promotional materials or other solicitation material, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures; 6. Compromised Servers or Network Equipment. MTG prohibits the continued operation of servers that have been compromised by third parties or automated agents. 7. World Wide Web. MTG prohibits Subscribers from engaging in any of the following web-related activities: a. Exploiting or attempting to exploit any scripts presented on a web page; 8. Indirect Violations. INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON BEHALF OF A SUBSCRIBER OR A SUBSCRIBER'S END USER SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY SUCH SUBSCRIBER OR END USER. 9. Reporting. Subscribers to MTG's services are required to immediately report to MTG (i) any event or issue which could compromise the stability, service or security of the MTG network and (ii) any known violation of this Acceptable Use Policy. 10. Consequences of Non-Compliance: Violation of this Acceptable Use Policy is strictly prohibited. In the event of any actual or potential violation, MTG reserves the right to (i) suspend or terminate, either temporarily or permanently, any or all services provided by MTG to Subscriber, without refund (ii) block and/or filter any abusive activity or (iii) take any other actions as deemed appropriate by MTG in its sole discretion. Nothing contained in this policy shall be construed to limit MTG's actions or remedies in any way with respect to any violation of this Acceptable Use Policy. Subscribers who violate this Acceptable Use Policy may incur criminal or civil liability. MTG may refer violators to civil or criminal authorities for prosecution and will cooperate fully with applicable government authorities. 11.IRC: We have a zero tolerance policy where child pornography is involved. . Mirage Technology Group will cooperate fully with any criminal investigation into a Customer's violation of the Child Protection Act concerning child pornography. Customers are responsible for the actions of their clients over the Mirage Technology Group network, and will be liable for illegal material posted by their clients. According to the Child Protection Act, child pornography includes photographs, films, video or any other type of visual presentation that shows a person who is or is depicted as being under the age of eighteen years and is engaged in or is depicted as engaged in explicit sexual activity, or the dominant characteristic of which is the depiction, for a sexual purpose, of a sexual organ or the anal region of a person under the age of eighteen years or any written material or visual representation that advocates or counsels sexual activity with a person under the age of eighteen years.
13. Network misuse: Excessive abuse of shared network resources by one customer may have a negative impact on other customers. It is prohibited for one customer to misuse or use the network in such a manner as to negatively impact network performance. PENALTIES: The penalties for violations of our AUP, including spamming and all activities described above, through our network is stringent. We reserve the right, to enforce this Policy to the strictest extent of the law, by, without limitation, issuing warnings, suspending or termination of Service, cooperation with legal authorities. 14. Complaints : Questions. Complaints or questions regarding this Acceptable Use Policy should be sent to abuse@mirage-isp.com 15. Suspension MTG reserves the right to suspend network access to any customer if, in the judgment of the MTG network administrators, the customer's server is the source or target of the violation of any of the other terms of the AUPs or for any other reason which Mirage Technology Group deems fit. If inappropriate activity is detected, all accounts of the Customer in question will be deactivated until an investigation is complete. Prior notification to the Customer is not assured. In extreme cases, law enforcement will be contacted regarding the activity. The customer will not be credited for the time the customer's machines were suspended. The Customer will be credited on a prorated basis based on the monthly fees the Customer pays for the servers that are suspended for the time the Customer's machines were suspended. 15. Cancellation MTG reserves the right to cancel service at any time. If inappropriate activity is detected, all accounts of the customer in question will be deactivated until an investigation is complete. Prior notification to the Customer is not guaranteed. In extreme cases, law enforcement will be contacting regarding the activity. All fees paid in advance of cancellation are non-refundable if Mirage Technology Group institutes its right of cancellation. Any violation of policies which results in extra costs will be billed to the customer (i.e. transfer, space etc.). . We at MTG shall continue to develop this acceptable use policy and may from time to time add materials necessary for further protection of our servers and clients.
